Elon Musk’s courtroom battle with OpenAI CEO Sam Altman officially began on Monday with jury selection in a closely watched trial centered on allegations that OpenAI abandoned its original nonprofit mission.

The lawsuit, filed by Musk, accuses Altman and other OpenAI co-founders of betraying the organization’s founding promise to develop artificial intelligence for the benefit of humanity rather than for profit. The trial is being held in a court across the bay from San Francisco and has drawn intense attention from the global tech industry.

The case highlights the growing rivalry between Musk’s artificial intelligence venture xAI and OpenAI, the maker of ChatGPT, which has become one of the most widely used AI chatbots in the world. Musk’s own chatbot, Grok, is positioned as a direct competitor in the rapidly expanding AI market.

Industry analysts say the trial could have wide-ranging implications. Wedbush analyst Dan Ives described the case as a “tech soap opera” that investors will closely monitor, warning that the courtroom confrontation could escalate tensions between two of the industry’s most influential figures.

During jury selection, potential jurors were questioned about their views on Musk and Altman and whether they could remain impartial. Responses varied, with some expressing negative opinions about Musk, while Altman appeared to draw less emotional reaction from the jury pool.

Court documents outline how Altman persuaded Musk to help fund OpenAI in 2015, when it was established as a nonprofit research lab dedicated to ensuring AI technology would be broadly beneficial. Musk later invested heavily in the organization before departing.

OpenAI later transitioned into a hybrid structure, creating a for-profit arm to support the enormous computing costs required to train advanced AI systems. Microsoft has since invested billions into the company and its leadership, including CEO Satya Nadella, is expected to testify.

Musk argues he was misled about OpenAI’s intentions, claiming the company strayed from its founding principles. He has publicly escalated the dispute, recently referring to Altman in a social media post as “Scam Altman.”

OpenAI has strongly rejected Musk’s allegations, arguing that his departure stemmed from disagreements over control and governance rather than mission integrity. The company has described the lawsuit as a “harassment campaign” driven by personal grievances and competitive rivalry.

The trial will examine whether OpenAI violated its original commitments to Musk and whether it improperly shifted away from its nonprofit foundation. A judge is expected to make a final ruling by mid-May, based in part on advisory jury findings.

Musk has also sought structural remedies, including restoring OpenAI to a nonprofit model and removing key executives, though he has since stated he would not personally benefit financially from any damages awarded.

As proceedings continue, the case underscores a broader global debate over artificial intelligence—whether it should remain a public good or evolve primarily as a tool for corporate and commercial dominance.
